reports and
presentations um there were a couple of
us here at 9ine and one was um Michelle
um from snap and she is unable to stay
so she sends her um regrets and we'll
get her um probably next month on so
that she can report out for snap um so
next up is our city county acos and did

okay hello uh board members my name is
Brian Hy I'm the case worker for Don
County animal control here to present
the
September
um
report
okay for the month of September we had
304 reported stray animals um out of the
reported Strays we were able to pick up
245 stray animals um out of those
animals 88 were cats and 157 dogs um we
picked up four sick and injured animals
it was two cats and two dogs uh we had
12 owner surrenders for the month of
September and they were all
dogs here's our reported stray animal
calls comparison for um the last four
years and here's our four-year um field
return to owner um and that's if they
find the animals um out in the field
they're able to return them to the
owners without having to take them to
the Animal Service Center or our cour
hold facility or wherever um for the
month of September we had
29 and these are additional animals
picked up we had zero owner surrendered
cats we had 12 owner surrender dogs we
had four sick and injured we had six
welfare holds um for those of you that
are new or don't remember welfare holds
are for if border patrol or Sheriff's or
Las Cruz's PD or anybody um arrests
someone or detains anybody um and they
have animals they and they're in the
county we go and pick them up and do a
welf for
hold um we had no neglector cruelty
cases for that month uh we had five
shelter quarantines we had one home
quarantine uh we had four courth hold
quarantine um cases um we have two
animals currently being held at our
facility
um shortly those two will be um taken
out one was resolved by court and the
other one's a
quarantine um we had zero rabes
submissions uh we had 36 diverted
intakes for the month of
September we had 462 education um it's
probably a little higher than that uh
because we participated in the fair uh
we had a booth out there so we were
doing education Outreach while we were
there um but it wasn't really easy to
quantify how much educ we did while we
were there um and then I participated in
some middle schools um I did a
presentation for um snake ID and um how
to basically not get bit by snakes uh
for the kids um and that was um for one
school but they were going to distribute
it amongst all the elementary schools
that they had so that was some more
education um for the month of September
we had 775 total
calls
and this is broken down by each district
um in district one we had zero cats and
six dogs District Two we had 31 cats and
eight dogs in District three we had six
cats and 29 dogs District Four we had 14
cats and 23 dogs um District 5 was a hot
one for us for this month for September
and that was probably because we had our
Aces project at that going on at that
time so we were more involved in in that
area uh we had 26 cats and 34 dogs
picked up and district 6 we had zero
cats and 18 dogs and in district 7 um
usually about every other month that's
usually our hot district and we had 11
cats and 39
dogs and these are our street cats
picked up by
District these are our straight dogs
picked up by District um like I said
District s and District Five are hot
ones for this for September um it kind
of alternates between those two don't
ask me why that's just how it
happens and these are reasons for our
owner releases um so we had two animals
um that they were unable to keep on the
property and they didn't want to get
citations um we had four that were um
they just weren't able to take care of
them we had one for
aggressive uh we had uh two that the um
they were just unable to control the
animals uh we had two that were sick and
injured and we had one owner that was
moving out the state and didn't want to
take the
dog and for that I stand for any

ma'am hello good morning Madam chair
members of the board my name is Gino
himz I the animal control supervisor for
the
city there we
go I am going to present to you our
September
numbers so for the month of September we
responded to 538 stray calls of those
229 were Goa we were able to apprehend
309 of those uh 250 were impounded at
this an service center 158 were dogs and
92 were cats we were successful in field
ring 59 animals out in the field which
meant means that those animals never
crossed the threshold of the Animal
Service Center uh we were unsuccessful
in field ring 29 of those and of those
they had some sort of identification
however for some reason they weren't
able to give them back to the owner so
we had a total of 88 identifiable
animals
our next slide is our reported stray
graph again we responded to 538 Strays
bring us to a grand total for the year
of
4,605 and as I've reported before this
is the number one Peak Performance goal
that we have um it says that we will uh
attempt to secure 65% of all Strays for
last month we were successful in
62% so a few months ago I rep reported
that we did reach that 65 goal 65% goal
um slowly but surely we're going back to
our normal
numbers next is our three-year field RTO
comparison again we field RTO 59 animals
bringing us to a total of 417 for the
year um this is our number two Peak
Performance goal of 25% of Strays being
secured and returned back to the owner
last month we achieved 14 per
.5 here's a graph for our community C
program we responded to 65 cats and
traps of those 13 were uh Community cats
so they were released out in the field
so for a grand total of 591 cats and
traps for the year and we were able to s
or release um 109 of those back in the
field that's about an
18% uh of our calls of 18% of the cats
and traps are being released
back here's a reason for owner relasing
animals five puppies unable to care for
five dogs unable to care for five dogs
with parvo four dogs with health issues
four dogs cannot keep in the yard keep
escaping three dogs for Dangerous Dog
admission three cats
um new location does not allow animals
three dogs for aggression two dogs um
the new place does not allow two dogs
were too many animals and one dog killed
another of their family
pets the reasons that we were unable to
fill RTO 23 there was no contact by
phone or at the
residence three owners were out of town
two chips were not up registered and one
chip was not updated the previous owner
was in El Paso and the new owner was
unknown and finally here is our excuse
me here is our last two measures for a
preep performance uh number three is
temp per reduction in stray animal bites
we were able
to not able to but there was a
22.8% increase in strayan bites from
September of 22 to September of
23 number four is a 10% reduction in
owner victim bites which was actually a
10.8
increase in owner victim bites we had
77 uh so far for 2023 and we had 66 for
2022 so our monthly calls for service
this month was
1,141 bringing us to a total of
10,640 for the
year some highlights for last month all
the acos are now NAA 1 and NAA 2
certified I was able to obtain some
scholarships for them for the animal
protection of New Mexico and every one
of my acos receiv received those
scholarships but there was a timeline
that they had to meet and September
October 1st was that deadline so all the
acos were able to meet that and now
they're all
certified with that because of that um
we had 175 hours of training that
included their NAA training and some of
the city required training as
well oh NAA stands for the national
animal Control Association sorry about
that you know um what kind of training
does it entail would be helpful there
are many many Madam chair there are many
many topics I think
um so each level has at least 12 topics
and we're looking at everything from uh
blood Sports dog fighting and
fighting care and maintenance shelter
operations impounding animal
identification exotic animal
investigations um those are just the
ones off the top of my head uh
photographing crime scenes
um
anyone that comes to mind
there I think in both levels there's
something like 36 different topics was
pretty detailed yeah yeah maybe a
presentation next month regarding that
sure would be helpful councelor Flores
is that you with your light on oh no no
no sorry you have your light on you want
to say
something I I did I did
if that's all right I actually have a
comment I wanted to comment on the
animal controls on the county side um
before Gino went up so I apologize Gino
um in the animal Don and County Animal
Control on the Asus project as everybody
knows the Asus stands for animal control
and code enforcement environmental
survey and those projects are going very
strongly and they have started up again
as we used to do for years years before
that um just to give you a report on
because those projects are inconsistent
with cleanup days where we go into those
rural areas and we provide resources for
those constituents in those areas and
the rolloffs and other resources that
come into those areas so the those
individuals can clean up their areas
instead of that trash ending up in our
desert it ends up in our dumpsters and
it makes it so much easier for everyone
so since the beginning of these cleanup
with Carlos days we have picked up
with animal control because it's it's a
partnership with animal control and code
enforcement and planning and zoning
we're not picking up the trash we go in
and provide the roll offs into the
community we alert them of the
violations that we see and then we give
them time to clean up that Community we
bring those rooll offs in that Community
they dump their own trash and clean up
their own Community that's the trash
that's reported that's being dumped out
when we when we do those weight tickets
great thank you so much thank you so
much and all of that is being paid for
out of out of the um El Camino Real the
IDP partnership so it's not coming
directly out of General funds wow thank
you so much officer thank you counc lce
yes and I had a question for you Gino
yes ma'am
um I'm sorry but um I think it was about
um let me try to yeah if you could just
maybe I'll get a

no it'll probably come you know like at
midnight I'll think about it oh I know
um all the calls that you get you get
thousands of calls right yes ma'am who
surfaces the phones I mean how how is
that managed it just seems like you know
a ton of uh calls a day yes Madam chair
uh board member FLOTUS
the majority of our calls come through
central dispatch um secondary would be
uh citizens calling our office directly
and then third would be uh
self-initiated calls for the officers
they see a violation and they start
their own card on that and then finally
way way down on the list would probably
be me when I get an email or a phone
call from a citizen that has some
concerns um I'll uh explain to them our
process and then if um they still wish
to speak to an officer I'll create a
call myself for the officers to respond
to so there's numerous ways that they
can uh a register complaint and uh
central dispatch U how is that uh the
personnel there uh I'm just it just
seems like so many calls I mean in a
given month um yes ma'am and so do we do
we have the staff uh the Personnel to uh
take to weather all those calls uh madam
uh board member Flores I understand that
as usual even mvda is short hand short
staffed oh sure sure um but they do have
call tickers and they have dispatchers
and at any given point those can um
cross train um but their man
24/7 and I'm sure that they could always
use more help I just don't know their
their numbers or their Staffing oh okay
that that that's out of your yes yeah
jurisdiction of uh whatever oversight
but okay I was just wondering because
it's just so enormous and there's always
shortages here and there yes um so but
we've never heard of any have we um
mayor protm I mean we've never received
directly any information about shortages
in that regard or councelor fles um
board member fles we have MDA has come
to speak specifically to counil related
a few months ago I'm wondering if but
adamal control no wda came and spoke to
um the calls that they receive and sort
of the capacity that they have and and
as a part of the conversation specific
to budget if you recall before in in
June or so okay because that was going
to be my question for
Leanne um do we get uh do we have a line
item for that should I know
that if I don't I apologize Madam chair
board member floors at just like the
Animal Service Center MDA is one we're
the Fiscal Agent for Murda so we do
deliver their financials for them uh we
do all of their procurement um I do know
just like other departments within the
city they do have staffing issues as
well um but um as far as I think the
director or executive director Hugo
costus came and gave a presentation I
think actually uh board chair it was
around probably before May when we
adopted the budget which probably I
think want to say March or April and
we'll probably do it again this year as
well at one of the work sessions for the
budget have him come in and give his so
um I we do I mean our finance does
attend their their board meetings but as
far as the operations I think um
commissioner Shannon is the lead on that
that particular board so okay thank you
so much Mr de I was just um yeah I was
just curious as to how um how the monies
are funnel to sustain these programs so
thank you so much and thank you Madame
chair supervisor am minus I wanted to
ask since we brought up the um item
around calls and the calls that are
coming um into mvda and then being right
um sent to you all um via some
process do you keep track of animal
cruelty I mean I know you do but animal
cruelty as it relates to domestic
violence because certainly there's an
intersection and we're finding more and
more right um um related to being a a a
deep intersection between those two and
what is your process like what is it how
many of those calls were children are
involved in that in in that anim animal
cruelty TK what is your process by which
you referring to other um entities to
investigate that particularly um abuse
and neglect right of children yes ma'am
Madam chair uh luckily I had sent four
officers to Albuquerque recently for
that the the link between domestic
violence and animal abuse I think it was
in September I'm sorry I didn't put that
up there on my slide now that you
refreshed my memory um so with that our
cruelty calls are really really minimal
I mean I'm thinking for the month we are
responding to maybe 46 just off the top
of my head so once the officers respond
to that call of course their their
priority at that time is addressing the
animal issue um should there be some
sort of um domestic violence or child
abuse child neglect what have you um
they will refer it to the appropriate
agency which could be LCPD adult
Protective Services or Child Protective
Services whichever they turn that part
over to those who have a better
education and understanding of what
they're looking for but yes absolutely
if we see anything that needs attention
we will report it
appropriately so I guess then my second
question is how do we do we see um from
the 40 plus calls more of an
intersection where domestic violence is
occurring
um given the the investigation occurring
and then how is it how is it being
identified in the reporting of MDA and
because I don't feel like and the reason
I'm asking is because we do see an
increase um I have a student intern
that's working um specifically on a
domestic violence prevention plan um
many of our calls that go into um LCPD
are DV related um and so I'm I'm Wonder
wondering if if if there is a mechanism
with mvda and what you're receiving and
what you're collecting that we can
really own in on because it just seems
like it's an epidemic proportions in in
my opinion and an only way to look at it
is to have well data to support it and I
don't think that we have a great
mechanism in place no criticism of it's
just the way we're collecting
information and that you know that FBI
is asking for certain certain things we
may not be really getting to the Crux of
the matter so I'm I'm wondering if if if
we understand with the calls even though
they're 40s something less than a they
nowhere a percentage 1% of all the
11,000 calls you've received thus far
but I'm I'm wondering if if maybe
there's a different way to identify
those calls Madam chair I think let me
let me make an example out of those 46
that we respond to for last month um
maybe the majority of those were for
Animals left in cars at a mall at at
Albertson at a retail store um so those
took the majority of those calls the
rest of them could have been labeled
incorrectly which should have been maybe
a care and maintenance more than a
cruelty so then they weren't um titled
correctly finally I think if if that
number is something that really needs to
be um given MDA would be the ones that
have that appropriate number because
then they would see that transfer from
the cruelty call initially uh
transferred over to Adult Protective
Services or Child Protective Services
whichever may be or the law enforcement
that handles that jurisdiction thank you
supervisor heis and Brian is shaking his
head head yes yes yes so yeah Brian
please please come up and clarify uh
Madam chair um Comm so um I know for the
donana county side um from what we see
um as me used to be in an officer kind
of know the in and outs of it um if it's
a felony animal cruelty um it would be
split from our card that we get called
out to to a card for the sheriff's unit
so they would actually split that card
into two so that way they could track
each side of it um and then if it's not
a felony or like he said it could be
mislabeled to a care maintenance
something like that and we would change
that but as far as um the county side um
if it's anything that's involved into
like a domestic and we get there um we
would split it with our Sheriff's unit
and they would go and do their side of
it so it's it's actually it would show
up on ours but it would show that that
it would split to the Sheriff's
unit thank you for the
clarification I sorry oh yeah I I just
actually have a followup about this
because it's kind of an interesting
councelor Corin and then I'm sorry Mary
Lou do you want to clarify some more
about this yeah I just wanted to add in
like um officer um Hy was going to say
in regards to that and probably Gino
would probably agree with me once an
animal control officer would be the
first responder for an animal cruelty
and they went in and started
investigating and they decided they
needed additional agencies on scene when
they and they turned it over to LCPD or
or the sheriff's department and maybe
Child Protective Services or Adult
Protective Services at that point they
would start that through the central
dispatch and they would add another
agency and they would add multiple cards
so they would split that what they call
split the card out so when you research
that in central dispatch it would go
into two different agencies so we would
have a have that on our statistics and
then Doo or LCPD would would have that
on their statistics as well in a
separate separate um Reporting System
you see what I'm saying I do I see what
you're what you're getting at but I'm
wondering if we're appropriately
addressing
really when there is animal cruelty and
you just said like you sent your people
to more training right to understand and
then be able maybe to ask the questions
I'm assuming um similarly to what we do
at CYFD Protective Services right always
learning improving the way we're
interviewing folks getting to the Crux
of the matter I'm wondering if just our
system I'm wondering if it's under
reported I guess is what I'm where I
were because our system isn't equipped
to handle like I'll give you an example
domestic violence and
juveniles when you
see battery on a household Member One if
it's not a top it's the second
juvenile's are are
um violent in households that isn't
being captured in youth specifically
juvenile specifically in our systems
because there's no way to do that our
system isn't capturing it so I'm
thinking like visionwise are we
capturing the right data specific to
this and how are we getting to the Crux
the root causes of that and maybe I'm
going down to Rob I feel like I'm going
down rabbit hole but I just want to make
sure that we're capturing the data
correctly and if we're not then
conversations need to be have with MDA
and others yeah Madam chair I think
you're probably correct on that we
probably does need to I mean I know it's
being like I said the carts and whatnot
are being splitted but in regards to
being um whether it's um being reported
you know appropriately um in regards to
those statistics it's probably not the
whole process the whole the whole um the
whole um you know the process going
around in regards to all the agencies
the way it needs to be the reporting of
that I I couldn't I couldn't answer for
that but I I'm I'm sure it's probably
falling short somewhere in there in
regards to that so probably I would say
maybe a task force going into there and
looking at the whole the way things are
getting reported into the 911 system and
looking at that and seeing if that needs
to be edited or whatnot into the mobile
CAD thanks Mary thank you yes councilor
Corin no I was just thinking about this
in terms of like the way that we're
thinking about it in terms of reporting
but I also wonder if there's a place
where we can do more so for instance if
if the call is initiated by
LCPD and it's domestic violence and
that's the that's it does it go the
other way that is does LCPD then call
Animal Control consistently like if
there's a child in a home typically I
think they would call cfd regardless of
whether or not the child's conditions
seem hazardous or not I think and I
wonder if something similar yeah
something similar could be sort of part
of a different kind of response to
domestic violence in particular because
it would be good to have an animal like
someone who can really understand what
the picture for the animals are and
perhaps that's a place where you know
there might be more evidence or there
could be potential intervention I know
that in many cases the issues that come
from people people staying in those
situations relate to their animals um
and perhaps an intervention point for
Education about what support there is
like if you want to leave this is what
could happen with your animals and it
makes me think about our mental health
response if we can have a similar thing
that would be inclusive of animals for
for intimate partner violence
potentially that would be really cool so
not really I guess it would add more
work to y'all's schedule but it feels
like it would be part of a comprehensive
look at that I agree I agree yeah just
been thinking a lot about about it U for
a long time and particularly that I have
a student that's working very
specifically on this and I know working
in the Child Welfare Arena that
intersection you see it and when you
talk about the data I mean the DV is
that's happening in this community today
it's enormous and I don't think people
know that um and I'm starting to become
more familiar with it just because it's
sort of in my face um two or three times
a week given my students um work um it's
really challenging and so um you know
when you think about the poverty that
also we we have in this community and
there's a lot of impact so I I like that
comprehensive look and maybe
understanding the referral process and
what is happening and how are we
capturing that data yes so Madam chair
uh just a follow up to uh board member
karan's uh
comments while you were speaking one
thing that came to my mind is that if
any law enforcement agency responds to a
domestic violence issue and they see a
child with bruising or even uh a
significant other with bruising that's
an easy report that's easy to do you're
not going to see bruising on a cat or a
dog so we need to be
more trained better trained to recognize
that possible animal abuse as well well
all of us are Mand mandated reporters
you don't have to see a bruise when you
see things like that it's a suspicion of
child abuse and neglect and knowing what
you know with the intersection between
DV right and children and animal cruelty
and those things that in my opinion
should be an automatic call to CPS
reporting right these are the things we
found in this in the home this you know
very concerned about it and and and even
you don't have to have all the detail if
you suspect you make the call
absolutely thank you Gino I'm sorry to
get into this a little more detail but I
thought this is an awesome topic that
like you I'm passionate about this one
as
well okay seeing any other thank you

okay next up we have
Clint couldn't get
to good
morning Clint faer executive director
Animal Service Center msia Valley like
to present to you the September numbers
for the Animal Services
Center uh currently there are 486
animals at the center this is um as of
uh I believe Wednesday is when this was
sent
out so
397 dogs 89
cats so our intake continues to grow as
you see here it's a total of 875 animals
came into the center uh 564 dogs 304
cats and the comparison there you see
that we are continuing to to go up and
up
this is how those animals came in uh
again our biggest like usual and and as
it should be is Strays by Animal Control
uh 503 animals that's 57 a half% came
from uh the Animal Control Officers the
next one is Strays by the public and
then the still staggering to me is the
owner surrenders 11 a half% that
came in so 101 animals
so our returns there's 16 total as you
can see there uh again we always try to
help these individuals with what they
stand in need of to be able to keep
their animal if they want to keep them
sometimes they just don't want to keep
them and and we understand that uh and
sometimes we are able to provide some
food we're able to provide some vet care
Etc that will allow them to
stay
our diverted intakes
151 uh divided intakes for those that
are watching the first time are whenever
an animal comes to the center and our
front staff is able to have them not
come into the center so whether like I
said with giving them food if it's owner
surrender or vet care or if it's a stray
animal that somebody found will'll have
them you know go back and contact some
uh we'll give them the information they
need to be able to post uh that the dog
is lost will file a lost report or a
found report then we'll be able to
encourage them to walk around the
neighborhood uh you know knock on doors
if anybody knows the animals so those
are all considered diverted
intakes and these are how those animals
that came in left uh the biggest one as
you can see is that euthanasia we
continuing to have to keep the
population down and the next slide will
show how
what those youth and Ages were but we're
committed to keep and and have our
animals at a level our animal population
a level that we can critically care for
and that's our overall goal uh almost
everything was down however adoptions or
lower than it was last year at this time
uh
reclaims uh rescues was uh was a little
bit lower they had higher number than
last time barely but a lower percentage
because we had more animals coming in
in so we continue to have that
fight September transfers 123 these are
where those animals went to for the
rescue groups um I did try to get one of
our rescue coordinators Elizabeth seed
here today so we could recognize her and
all the hard work that they do but she
flat out
refused and said no she does not like
public speaking nor appearing in public
but she did say please mention my name
and say what a great job we're doing so
that's what I'm doing they're doing a
fantastic job we appreciate all that
they do um Liz and also Amy is the other
one Amy's off for the week or else I
could have gotten her and then we have
another one filling in that's being
cross trained her name's Kim and she
does a fantastic job as well they are
driving back from Phoenix today after a
big uh drop off of animals occurred
there with our halo transport Partners
so we're very thankful for
that so here's the euthanasia reasons as
you can see the number one reason again
is space medical you can imagine
whenever whenever there's a space next
to something that means that we needed
to uh
euthanize and we euthanize for a medical
reason but if we had the space we would
have kept it and held on to it so the
reason with these the Medicals are so
hard is we have a dedicated team of um
ones that uh dedicated their career to
saving animals and making them healthy
and they just don't have the space for
it and that's hard for my co-workers
that dedicate that
time however we're we're continually
increased or we're continually looking
forward to the new center opening
because that will allow the existing
Center to be able to be a medical
facility uh however that does not
increase the number of people that I
have that can care for for it so even
though we're going to have more room and
we may even have some empty kennels
we're going to rely on see if we can get
volunteers see if we can get uh
Community workers that already we we
already have those but see if we can
continue to get those to help with other
things and that will relieve time that
our Medical Department Can Help the
Animals As best we
can here's our surgical Department uh
amazing work that they do 3 162
surgeries and you can see there uh the I
don't know what color that is
aqua color is for
September you can see we did a lot of
TNR surgeries that were coming in a
little low on
adoptions uh however the shelter Foster
and other continue to make up for that
they just do a fantastic job other is
anything besides those three that you
see there TNR adoption and shelter
Foster is what other stands
for total of 603 hours for our
volunteers amazing work they have been
so busy going out to the public a lot of
times we have uh like they just went to
White Sands and it was it was an
information booth is what it was and
that's where we utilize our volunteers
quite a bit that means that we do not
have to have a staff person there so we
are going out in a lot more different
places so it's just an information table
volunteers do a fantastic job of housing
those and getting the information out of
what we're
doing also of note our volunteer program
has been selected by mty's fund they're
a major player in the animal industry
they've been selected to uh have our
program evaluated so we're going to be
sending questions out to our volunteers
we vetted the questions uh just this
week those questions will go out and
we'll be able to there's questions like
um of what qu what can you what would
you like to see change in the volunteer
program at the ascmv or how can we
better make the program more or so just
good information that we can glean from
these vast amount of volunteers and
hopefully we'll get good participation
in that and grow the program from
that our visitors visitors were down
just just a little bit he ended the
month
at400 uh for the month of
September our web page views went down
as well uh to 32,900 almost 33,000 for
our
website Facebook went down a little bit
uh Henry did not have another birthday
so we had to drop a little bit from that
but it continues to be the main source
that we have and I think this reflects
it how has a continual uptick of usage
you see there all the way back uh in
when we jumped way up in November of 22
it's just been kind of a steady increase
all the way up uh we do fantastic we
attended a training just this last
Friday or Thursday I
believe uh or Monday I'm sorry I think
it was Monday of um by the city on how
to properly use social media best ways
to get the attention and individuals on
there and also to make it more ADA
Compliant so we're going to be working
on that as well I learned that on ADA
Compliant they have a system that reads
the website for them but the that does
not pick up images and so you have to
use another process to be able to to do
alt text and they can describe the image
for it it was
interesting some of our upcoming events
that we have working with the fire
department have adoptions at Firehouse 1
on November 4th we're going to be at the
uh community resource fair and phry fair
at NMSU on November 15th November 8th is
the national adoption week we'll be
partying hard on that week trying to get
animals out as soon as we can and then
on November 18th we're also going to be
at the icebox Brewery which is a very
popular one for my co-workers to go to
uh they all enjoy you have to take uh
you know rock paper scissors to see who
goes that one but we all we love these
events coming up um our volunteer
department does a fantastic job Yoli is
amazing in what she does and getting us
out in the
public and Milo was adopted pretty darn
quick so our cat of the week was adopted
we're excited for that and then mooki
still waiting for forever friend and

um yeah that includes the subtype owner
surrender so if they bring if acos bring
one in it does conclude that all right

couple quick questions one is you know
you alluded to the staff I I understand
you guys are doing a staff sort of
position
study um so I'm hoping that in the
upcoming budget Year we will see some
clear sort of Staffing up Staffing
implications for for us to increase that
um do do you feel like that will be part
of what will come into our budget
conversations well we're currently doing
a compensation study is that what you're
referring to uh no I'm looking I'm
wondering about sort of the like
position count how many people you have
uh what what you would need going
forward because I think since we're
about to discuss budget and you
identified a shortcoming I'd like to
know if if you're going to have some
numbers for us when we go to the budget
process to to the best of my knowledge
we don't have a center wide study like
that going on right right now now we're
not in part of one I do know that um we
have our budget analyst and operations
director which is Bernice they're
working with one another to see what
jobs can be switched over and shared uh
with those two but as far as a a center
wide program no we don't we're not
currently in one to see if we have as
many as we need uh but I can definitely
look into one and we can can get one
started uh I can tell you that we we did
increase what we thought we needed to to
house into a new center uh the challenge
and that was last budget year we
increased positions the challenge has
been is keeping these positions filled
uh one new position that we have that is
is in the interview stage here shortly
is staffing specialist and that's the
one that we requested for this last
budget year that will be immensely
helpful I've already discussed with HR
and how that's going to be helpful
uh to move the process along a lot
smoother uh right now we are it's hard
to get communication through HR just for
the means that they are slammed every
department needs hiring every department
needs the the the process to move
forward and so everybody's calling and
saying please do this please do this and
it only slows the process down when we
submit something that may not be
complete like like there's a hiring
packet and if that's not all complete
everything filled out correctly
everything grinds to a halt get the
request the information I mean it can
you know sometimes take three three or 4
days to get the information back but
with the staffing specialist we can have
all that information put together and
then sent um they'll be able the
staffing specialist will be able to do
appointments for the the tours and it's
just going to be a lot smoother
operation and hopefully fill those a lot
more quickly so the issue is not that
you aren't budgeted for the staff to
have both things functional it's that
they you just don't have those
staff I would say uh in my opinion we
need more staff because of the issue of
staying full staff does that make sense
okay so I I guess what I'm suggesting or
very strongly suggesting is that you
have a clear picture of this when you
submit your budget and what those staff
positions are and uh what's needed to be
able to increase that capacity so that's
I guess what I'm asking for you to
follow up on yeah and there is a
mechanism that says especially the New
Mexico State law and the but there
suggestions that state that each hour or
each animal has a certain amount of time
that they are Touched by an individual
or cared for and so if we go by that uh
then we can get some solid information
for you sir thank you yeah that would be
good because I think it's important to
us as we consider the budget and that we
have really clear picture of what
positions you're requesting ing in the
upcoming budget cycle so um the other
question I just have and I'm sure this
will come through the facilities is that
is there a a time for you guys to be
opening or
transitioning uh there's nothing set
however there is a request for
completion date on our part we've
requested that things be solidified and
completed uh the second week of November
so we can get in there we have a
community
uh Community Day of
unity I'm sorry I forgot what the name
of it was but it's November 18th and
it's going to be there at the facility
kind of a soft opening kind of a thing
where we have people come in we'll uh
they can see the dogs and the adoptions
the only thing that needs to be
completed are the Landscaping in the
cement areas the cement get acquainted
areas the cement has been poured so all
the all all the areas have been poured
Bo so now we're just waiting for rock to
be put in and they were doing that
yesterday uh I do I do know that he said
they need more rock to come in and
fencing completed in our playards for
those to be completed but we can get in
without those being completed so we're
really close super close the thing on
the 18th is actually my community
meeting so that's uh partly why I was
asking because I didn't want to put
something on you just before we
officially make that I don't want to put
it on you all when you have a lot of
other things going or if that wouldn't
fit with your timeline but if you feel
like that's still that's doable um then
okay I will Yeah we actually had an
excellent talk uh yesterday a group
meeting about it and uh we feel strongly
that we'll okay be by the 18th okay if
not we have a b plan okay awesome just
checking and that'll be exciting I think

meeting with each individual department

yes we're we're already doing
forecasting for the revenue and trying
to U meet with Mr peely and trying to to
finalize everything so that way we can
uh open up our Erp and start everybody
entering in so that way we can meet with
C the council and have our budget um
Retreat right in February yes hopefully
three days from8 to five so um Leanne
how would Clint be working with Joe or

working with Joe to
assure that um there's
budgeting um you know that the correct
budgeting staff budgeting is um is
discussed met and hopefully filled
because it's it's a process and
everything is time time time and and U

speaks to you or EO or if I could I this
is a process that we've done in the past
um I don't think it's changed but
there's forms for that in the budget
preparation so we would fill out those
forms and then and I'd also have
discussions with my HR

to um have that discussion if if after
that form goes then they usually contact
me and we have a discussion about they

um wanting a good outcome in so far as
you know the center being um fully
staffed and I I understand that we have
Monumental vacancies in the city I I I
think they're Monumental in my humble
opinion um we we have so many vacancies

going to fill those vacancies and what
um what should we be doing to assure

because our um we have crucial people

for the for the service center and uh so

financial statements for the end of

right um starting with the statement of
net position highlights we have our our
cash that is at 1,

25 we then offset that with our
liabilities which is at

following that we have our revenues
collected in advance and those are at
27,600
and our total liabilities and fund
balance is at
1,373
25 moving forward we go on to our change
in net position our total revenues for
the end of September were
1,559
240 and then our total expenditures were
at
827,000
our budget to actual and change in net
position again we went over our total
revenue which is at
1,559
240 um bringing our our budget our
budget budget parameter is at 25% I
didn't mention that um So based on that
it's at
33.4% our total expenditures are again
at
827,000
three and that's at
17.4% of the budget um bringing our net
change to
73183 our revenues in
expenditures um throughout the period
there is a decrease in revenues and that
is due to the cities and counties
contribution that was at 36.2% and that
was on the previous slide um you'll also
notice a slight decreases in services
and that's just due to the nature of
expenditures

our expenditures our year-to-date
expenditures were at
827,000 of that the total made up of
salary was
59% our benefits were at 20% services at
10% supplies at
7%
other is at 1% and then insurance is at
2% all the other Capital repairs and

committee chair um report and um what
was discussed um and was obviously the
agenda but there is some conversation
about um the 501c3 I think we'll be
talking more about that um here
shortly um there was um discussion of
the jpa
approval um and also since we're going
to be moving we hope to quarterly
meetings having Clint participate in
those meetings when there are agenda
items specific um to animals am I no oh
I messed it up here comes Clinton to
correct
me Clint AER executive director the so
the the meetings part was is for me to
go to the commission meetings and the
council meetings that occur with the
City and the and so whenever there is a
animal topic isn't that what I said you
said the the quarter meetings for the
board oh got you I and I mean I can
attend those when there's ever there's a
animal related one if you want me to but
I think I'll be to everyone actually so
that's the only

facilities the facilities uh committee
met on October 5th at the new facility
thank you for Clint for that wonderful
uh tour we got um as Clint already said
they did
pour uh the pads in the meet and greet
area so that was done the poles were
being cemented in while we were walking
around the facility um the puppy cages
are in there was issues with the trim
not aligning with the top of the wall
and I believe that they have those on
order so those are good to go um the
wireless wires have been installed for
the routers have we gotten any update on
that or are we still waiting
on routers to be put in wireless routers
wireless routers for the wires for the
wireless routers thank you yeah so it's
all been wired and we're still waiting
for the hardware it's on back order
perfect so we're and the trim is being
currently installed around those puppy
cages as we're speaking yep like as I
say this as you're saying that they're
using their drill it's because of
magical um cat kennels are under
production no shipping dates or do we
have a shipping date yet we do we just
found out last meeting which was the on
Tuesday that they are going to arrive
the week of November 6th perfect okay
awesome there is some they sent a quote
for us to purchase remember we wanted to
purchase or I wanted to purchase the
ones that we currently have but there's
a quote where they want to charge me
$30,000 for another just to buy 24 walls
cuz remember they're all stacked
together and so that wall is shared by
two cages so I need another wall if I
want them to be separate so but they
charged they they did some like they're
trying to make up for the price of the
discounted one with the with the walls
and they so I got to go look at the the
the existing cages and see if we need
all the hardware there're saying we need
or if we can
just you know go without it so but I
think that's ridiculous for $30,000 for
24 walls that's that's a lot and that
that jumps the price all the way up it's
um to 90,000 almost $9,000 and I can't I
can't do that got it did we have any
updates on the key cards that will work
at both facilities they're waiting for I
talked to them um and they're waiting
they being facilities is waiting for a
PO to be
generated for to purchase new cards that
they think might
work might work okay yeah waiting on a
PO for cards that might work might okay
um cameras are all set up and running uh
exception is in the the kennel rooms
have those been put in yet and running
or no not yet not yet not yet okay
they're all installed we're just waiting
for the connections to be made perfect
for that got it okay and then the
dishwasher arrived and it is installed
are we still waiting
on quotes so we got quotes for because
let me back up they have to be installed
by a licensed electrician and a licensed
plumber or avoids the warranty so we got
quotes for those to be done uh they
require because of the intense Heat that
these commercial dishwashers generate
that has to have special Parts it can't
just use regular Pipe PVC pipe to go
down into the drain so we are they're
waiting for parts once those come in the
plumbers will install their plumbing
parts and then the electrician and then
move the the the dishwasher in and then
the uh electrician will make their
connections and they're going to do both
of them at the same time the one of the
new and the one at the old yes sir cool
perfect and that was all Madam chair

overview of 501c3 status Clint you want
to do some introductions and move us
along on this agenda

so joining with me today up at the
Das is uh Benjamin he is the attorney
for the
ascmv and uh we've had quite a few
discussions about this on the over the
phone and in person but first I wanted
to give you a little bit of some quick
facts of how this occurred uh and and
why this occurred so back in May Kelly
Barker reached out to me saying that
the Humane Society of Southern New
Mexico is going to be disbanded and she
want she asked me flat out if I would be
interested in taking over that 501c3
designation instead of starting one from
scratch and if we are interested then
she would make plans to touch Bas with
uh Mr Bryce who's the executive director
of the main society southern New Mexico
I said we were interested and I would
like to see some information so May 8th
uh she contacted Mr Bryce Mr Bryce
agreed to it he was in support of uh the
asmv taking that over he
understood that the Humane Society in
Southern New Mexico would be no more uh
and Miss Barker was really uh adamant
that something happened to to be able to
hold on to that Legacy of what the
Humane Society of New Mex southern New
Mexico has done through these years
they've microchipped and Prov provided
chip scanning just they've done a lot of
great work so we do want to be able to
uh hold on to that Legacy as much as we
can and recognize for that that work May
31st I was notified by Miss Barker that
at that time all of any of the remaining
uh board members from the heing Society
of sou Mexico had resigned so that kind
of threw a monkey in the wrench of like
just like we do here we would meet as a
board and say okay we're going to
dissolve and here's what we're going to
do with everything well they didn't have
a board they only had an executive
director so with communication with our
attorney uh in June we were able to get
a resolution started and and drafting
one out that says that Mr Bryce has that
in the meantime back in June uh of
2023 and June and July our attorney got
in touch with the uh it would be the
accountant for Humane Society of sou New
Mexico because we wanted to be sure that
everything was in good standing and it
was they did a fantastic job in all the
books that they held there was money in
the account uh and all the filing to the
IRS was current so everything was a good
standing so that was excellent
news so on September 11th the the uh
resolution was sent to Mr Bryce and he
returned it and signed on September 28th
if you remember that is about the time
of our last board meeting when these
discussions were happening and I'm like
this this is all new stuff brand new
stuff that we're discussing is just
happening so we'll have more information
for you so that's why we're here today
for
that uh I I do want to go over and this
is uh something that I did really quick
this morning is I said let's show the
board the advantage of having a friends
of the ascmv before we we get into it
all I did was Google animal uh animal
industry grants with nonprofits or 51 C3
and I had a whole page and I just
grabbed five right off the top that I
could do I mean ASPCA you all know it's
a very popular name they give grants
specifically cash grants specifically
for nonprofits that we could look for
Banfield Foundation you've heard of that
one uh with the vaccines and their
hospitals that they have so various it
says right there various opportunities
for 501c3's the give effect they like
this one for software that can help uh
non profit organizations be able to go
paperless uh the gry muzzle organization
specifically for senior pets so all
these are things that we would not be
able to go after as a a government
municip
municipality so I would like to have um
Ben come up and we can discuss any
questions or changes you might have I
know we have some great questions from
uh Barbara Ben Como that
that emailed out to all of us so we're
going to address some of those and
answer also any questions that you may
have thank you Clint before we move on I
think c um board member Corin has um a
question and counc plotus I guess I have
a question and I just really this is
really just me throwing up several Red
Flags uh I know that Frank Bryce has
dementia so I I want to be transparent
and I know that he had dementia when he
signed this paperwork so I would beg a
lot of questions that he's the person
that we can count on to make those
decisions I know that um the county has
had a history with Kelly Barker that
was included a lot of misinformation and
ultimately ended very badly uh so I
think that's also that also raises
significant questions so and the it from
what you said everyone on the board
resigned so that's a third red flag for
me in terms of where this money is
coming from this is separate from the
idea of a 501c3 friends of organization
I have really deep-seated questions
about how this money is would be coming
to any organization um I would want Buy
in from a board of a community
organization that existed and if they
resigned abruptly that's pretty red flag
to me so so I I just think I regardless
I understand the idea of a friends and I
think we should consider it um as a
possibility I don't think that this is
these are the conditions that uh seem
right to um take money from an a
community organization via a person who
I I don't think we should really have a
lot of faith in in terms of their
governmental relationships and history
of um kind of questionable Behavior
within within that space so um so that I
guess I just really want to raise those
red flags and I think they're separ
frankly I think they're separate from
the idea of having a 501c3 or a friend
of
organization um and I would really like
us to
consider I don't I'm not I don't want us
to quash the idea of a friend of and all
the things that go into that because of
this um but I also would say that for me
there are some ethical considerations
that I think uh are deeply troubling in
this series of events you're stating
that Mr Bryce had dementia that was
never told to me I never that's brand
new information I don't know how we can
confirm that with HIPPA laws and things
like that I know that he moved into he
sold his home and moved into their own
or uh living
facility so
I I personally know the folks in the
animal community and have heard this
from many of them so so I mean sure
there are HIPPA laws and then there's
also um a person a different person who
I think is not a reliable act actor
working on behalf of someone it's very
very suspicious to me sorry yes and to
address that as well she contacted me
and I can show you the conversations we
had and it was because it's all via
messenger and uh she said she did not
want to be involved with the with this
organization at all U she said she was
as a friend helping connect the dots
with Mr Bryce but she didn't want not
want to be involved in this organization
she didn't want to be on the board she
doesn't want any of
that coner just a moment concer lus um
well I think that um I have the same
thoughts and sentiments as um counselor
Coran so I need not repeat it all but um
but I do have to emphasize that uh the
woman in question is um someone that we
should not be associated with at all so
thank you um thank
you for being eloquent about it um board
member SEL Hernandez is um is there
money tied to this or is it just the
nonprofit status that we'd be taking
over so they do have an account and it
had $511 in it okay and that money was
sent to us already oh it's already there
yeah we did not ask for it Granite
Mountain I believe it is is they sent it
to us and that just was received on
Monday or Tuesday there you go all

right and went to the center yeah well
it was given to us in it's given as a
gift what it's given to to the city I
don't know
no so there was there was no
communication on what one moment please
one moment do would you like to have the
floor um board member Flores or if you
have some questions I'm happy to give
you the floor no I uh please accept my
apology for interrupting uh board member

problems uh I think the question now
just is is since the money is already
not in the account now in the hands of
animal services that does pose a
different question as I did not know who
this person was until
I talked to Google about it
um so my question would be is we do have
a presentation
correct there's a PowerPoint for this uh
that was the PowerPoint that was it that
was everything that was everything just
giving you the information of how this
came to be and now we're open for
questions to so it sounds like there's
two issues that we have is one with the
person of how this came to be and second
of what this organization is going to be
okay and that was the purpose of this
discussion was to to let you know this
is what we're thinking we have our
attorney here that can talk more in the
legality of best methods for this
organization of is it going to the
method the words of financial arm was
used and just clear up that confusion of
of how I see it
happening okay Madam chair what I would
recommend is there definitely needs to
be a discussion
on what this mechanis or what mechanism
this is and how it's being used and
utilized and so on and so forth I think
that's a great idea I think it's
probably a better idea to start an our
own nonprofit 501c3 status for Animal
Services Center and not take over
someone else's I think might be a better
idea right now especially with
individuals tied to it um so I would
love to entertain the conversation of
having a friends of I am strongly
opposed to taking over the um previous
nonprofit
501c3
personally
ditto councelor Flor thank you Madame
chair ditto um so I I agree 100% with uh
board member um saljo Hernandez and uh
but I do have a question about that
check where is it uh we have it in our
safe I think you should return it to it
was that sent by the woman in question
no it was sent by the the credit union
sent it's a Credit Union check credit
union what was the name of the
credit who what is the I mean the can't
the credit union may be the you know
whatever the holder of the money but and
there may have been some communication
on that end between Mr Bryce and uh
Barker and the credit union saying
that's all closed send it to the ascmv
we did not have any communication that a
check was coming uh we just knew that
there was money in the account I did not
give a go for it to come neither did
Bernice because we were like what's this
check for when we got it to whom is the
um check written out to the ascmv okay m
M de do can you shed some light on some
uh in that regard do you have any
knowledge about how to handle a
situation like
that um board board chair um Madam
Flores if this is a donation which Clint
gets plenty of donations last year he
received
$47,000 in
donations if this is what they want to
do is they want to bring it in as a
donation with I'm assuming no strings
tied to it we can deposit that check in
the in the
bank um it would go into our bank and
then it would be on the books for Animal
Service
Center thank you yeah and that that was
the that was the idea of it but then it
clicked the name of the credit union so
I can reach out to the credit union and
find out what their what they want us to
do with this check that did they mean it
for money to go into the new 501c3 that
could possibly be done and that's their
starting money for it that that was our
worry of why we didn't just go ahead and
deposit the money and cash the check but
um Mr ther the credit union is just the
uh vessel of the transferring of the
money it's not the the owner of the
money so um who it was the Humane
Society the one that uh
disintegrated is that the one the it was
Society of Southern New Mexico's account
it was okay somehow um I feel really
squeamish about that and um I would U
again
um concur with uh the comments by uh
board member sjo Hernandez and board
member
Kuran um and I would like to emphasize
that we should not have any connection
whatsoever um with Miss Barker and uh
and agree totally with
uh with uh the uh capacity of agree with
counselor excuse me board member
Karan as to um Mr Bryce's mental
capacity I think if there's any doubt
and um I mean I'm I'm not I'm not privy
to his his uh mental status but if
there's any doubt we should uh
definitely be careful about that and I
don't know how to go about that at this
point um I'm I'm relieved to learn that
the check is sitting there in your safe
um but
somehow I I the whole thing is just
uh it's problematic for me and I I have
no recommendation or
solution uh just a request that uh I I
think maybe run it through your
attorney um maybe we have to run it
through Finance
um but yeah it it just doesn't um yeah

Service Center we can work with Bernice
and look at this uh because it sounds to
me that probably what they did somebody
went to that credit union closed that
account maybe and said can you please
send the you know send a money order or
check to Animal Service Center and
that's
because you're saying that it's not from
their bank account but actually from a
bank you well Credit Union thank you
yeah it doesn't say if I remember
correctly the check does not say Humane
Society southern New Mexico on the upper
left it's the actual Credit Union yeah
and um Madam chair it sounds to me that
what they probably did was close out
their bank account so even if you tried
to send it back there probably is
nowhere to send it back to so we would
need to NE you know talk to the bank as
well to see what their recommendation is
because they would need to reopen that
or they would probably put it in
unclaimed property and then it would sit
there in that unclaimed property
so thank and I like I mentioned before
I'm sorry thank you board member um
de Clint I'm sorry I was goingon to say
that like I said before I don't have any
problems of making contact with the bank
they have to keep some type of record of
why this money was sent was it requested
to be closed and we can we can find that
information out that would be my
recommendation is to um direct you
recommend that you communicate with the
credit union um and and just understand
if this was a donation a contribution to
the Animal Services Center um because if
there it's money but it doesn't have any
attachment to doesn't say the Humane
Society so I would recommend that you do
your due diligence and figure that piece
out um I'm sure Ben can help it's been a
long time Ben good morning um and I
would that's what I would do okay it
will be done okay um Ben's here please
come to the podium and speak on behalf
of what you have found
out um related to the 501c3 I think did
you get a copy of board member beno's um
concerns and I think it behooves us to
have you go over those and see if
because it sounds like and and it's been
the will of this board for many um years
um this has been a goal of Clint and I
think it it it's it feels like it's more
um visible and attainable and it may not
necessarily be with this but I'd like to
hear from you Ben thank you thank you
very much Madam chair I appreciate that
um good morning uh members of the board
for those of you I have not met before
my name is Ben young I'm an attorney
with Minette Springer here in town we've
been representing the Animal Services
Center for many many years um and uh so
it's a pleasure to assist in matters
like this I come up and relatively uh
new type of issue and I think that the
spring board for this conversation again
is um what Miss Barker bro to back in
May and that was what was able to assist
with reinitiating this conversation a
lot of the things that were just
commented on earlier we can address I I
believe the
hsmm financial accounts were all being
handled by their accountant which is who
I had been in contact with over the
summer um so it would be a relatively
simple thing of contacting the the
accountants office to find out exactly
what transpired with the exchange of
funds
it is at the stage we're at in the in
the communications with the on the 501c3
transfer or change of designation issue
all that we had received up to this
point was that resolution which
authorized the Animal Services Center to
work with the accountant on determining
whether or not this was a feasible thing
for the asnb to do or not so it's we're
very early on in the in the process with
them um I I don't think and correct me
if I'm wrong on this Clint I don't think
the
the shift for hnm to be associated with
the ascmv was ever about the money in
the accounts but more about the
connections and the historical work that
hsmm had done whether or not they had
contacts with other Grant entities and
those types of things if they did have
historical um accounts with different
entities that that would be something of
value it wouldn't be a brand new 501c3
starting from scratch developing these
new relationships but it would be
something that would already give us
boots on the ground moving forward I had
no indication when this stuff started
that how the nature of Mr Bryce's
illness um but that may if if it is what
if he didn't have capacity to sign this
at the time in September we may have to
revisit that issue so that's something
we can treat differently um as far so so
now transitioning into the friends of
organizations the over the course of the
last couple months I think there had
been some confusion as to what exactly
the board wanted um with respect to this
organization did we desire it to be a
subcommittee of the ascmv that was
tasked with going out and Gathering um
funds whether from Grants or different
entities and then bringing that to the
board for the board to decide how to use
it or were we looking at establishing or
use whether using the existing 501c3
that tweaked its Mission or establishing
a new 501c3 who is tasked with obtaining
grants funds connections with different
people to benefit the ascmv
independently and so those are that that
was an area of direction that we needed
from the board there are pros and cons
to both uh to both structures the the
pros of of having an independent 501c3
as a friend of or a foundation type
relationship kind of what the university
has um is that they can operate and get
connections with entities that have no
strings attached can give money to a
501c3 get all the charitable deductions
that they need which are not always
available for government entities the
issue that government enti or that
individuals run into who want to give
money to a government entity is there
are some types of Grant that don't
qualify for the charitable deduction and
so they would rather give to a 501c3
than to a government entity um and
that's where the benefit and so if we go
that route it's a much larger broader
world of Financial Resources the
difficulty with that though is you do
have a SE completely separate
independent board um that has to have
its own structure that has I would
recommend strongly have its own attorney
have its own CPA all of those things so
they would need to be organized
separately but they do exist only for
the purpose of benefiting the ascmv I
know historically there's been some
difficulties with those types of
relationships that have turned sour and
that's where a lot of the questions in
the email from uh from board member Beno
were were were addressed to the benefits
of having the uh The Entity serve more
as just a subcommittee that you form
it's easy to set up and you have
complete control over what they do and
how they gather resources and where they
go about um asking for for donations but
the world of of resources that they have
available to them is limited um they
don't they wouldn't be able to do what
Clinton did this morning and just plug
in a Google Search and apply for every
one of those uh items and or apply to
every one of those entities and receive
the the donations or the grants um a lot
of them would be exclusive of a
subcommittee of a government entity so
that's where we stand I'm happy
to we don't want to go we didn't want to
go too far down either Rabbit Trail
until we had clear direction from the
board we want this and then we're able
to assist with setting those things up
if the board does want to go the 501c3
route there will be a lot of uh
interconnected I think working there
will be some legal aspect uh from the
ascmv side but I think there will be a
lot of community networking that will
need to be done there will need to be
board members recruited there will need
to be um by those board members then an
attorney potentially retained who's
willing to do those to do that work for
them I'm happy to answer questions now
or thank you Ben yes Council um board
member SEL now you're a council member
sjel Hernandez board
member um like I said I think that the
501c3 status would be great I think
that's
fine um um after hearing two options
thank you for those two options um
option one sounds like the more
beneficial way to go through this for
funding but also after sitting on many
boards that are nonprofit and seeing how
many nonprofit boards there are in Las
crues that benefit Animal Service and
Welfare here in in our beautiful city
and town um It's A Hard One to kind of
stomach I mean funding is limited
everyone's going after the same dollar
um
I don't know if we want to also have a
another board that's looking at other
finances separate from the finances that
we're looking at on a daily basis but I
would love to see like where the funding
is going to be used how it's going to be
used what they're going to go after are
we going to give strict parameters of
let's go after you know Education
Services and this and that or is it
going to be broad or the other option
which you said was to bring it under us
which limits their capacity but also and
maybe um lean maybe that's something
that you can help answer for us because
if Animal Services is already getting
donations from public from Estates
whatever it is the money is going into
the operating account and being
dispersed I would guess so we're already
not kind of designating where those
donations are spent they just go into
General operating then they go towards
the $30,000 walls for the kitty cont or
you know things like that
so I I like the idea like I said but I
want to see parameters of where where
your vision is and where you want to see
this go because like I said you're
seeing you know they just closed Humane
Society of Southern New Mexico they you
know they're disbanding and they have
$500 in their account that kind of
speaks volumes to me of like what are we
actually capable of doing in our
community with limited resources um um
so personally I just want to see kind of
a layout of where you want to go with
this how you want it to be set up do you
want to see it as a board that someone's
going to have to manage someone's going
to have to run you know grant writers I
don't know if we have a separate board
is the city or the county going to come
in and offer grant writing services
probably not that's probably going to be
something that's going to have to be
funded by this board with no money in an
account
so I just don't want to see it being a
huge burden one on you Clint because you
do have a lot on you have two facilities
that you're running um but also on this
board that already is struggling to put
forth finances every year and go through
that I don't want to add another element
of headache um but I would like to see
where your vision is on this and direct
parameters of where the money is going
to go and how it's going to go but Lan
if you have insight to this I would love
to hear it because I think I'm kind of
on the right direction here but please
do chime in
so um board
chair the the friends as in so we have a
couple of friends like the friends of
the
library and and that's a good one they
provide they go out and they get um
financial means to buy books for the
library they help with publicity you
know for educational programs and things
like that um we do not monitor them in
any way I don't think believe that staff
is actually on the board or have any
really direct connection with them other
than probably attending and letting them
know what their needs are things like
this as um the counselors will know in
the past we we have had issues you sort
of alluded to it that we have had some
issues with one friends group in
particular and it caused quite a bit of
uh controversy around and and we're
still dealing with even things now
trying to make sure that we abide by
what um an big audit that we had done
you know Council Flores um alludes to it
multiple times at the finance select
committee making sure that I'm on track
and making sure that I dot my eyes and
cross my tees and I thank her for that I
think uh one of the items that um Miss
benom had in her email was how do we
keep this separated um if it's they're
going after grants that affect our
facility our operations that is really
funding that should come into the Animal
Service Center so that way the board has
Direction on helping to spend those
funds but with friends M and maybe Mr
Young can help us it's a total separate
entity there would not be brought to
this board at
all and hopefully I've answered your
question I
apologize and board member Madam chair
I'd be happy to address that at least a
little bit a lot depends on the
structure of the bylaws um that is that
are ultimately approved the the way that
I understand the 501c3 regulations for
this type of entity the friend of the
foundation that exists for the benefit
of some other entity um is that you can
put particular parameters in there to
ensure that the funds and from certain
portions are used in a particular type
of way another way to ensure at least
some level of accountability it wouldn't
be control or oversight because that's
what we need to avoid but it would be
something like having one of either one
of the board members or staff
or someone who we would the the the
board would designate as an ex official
member of that 501c3 so they wouldn't
have voting responsibility but they
would be able to participate in terms of
presenting the needs of the shelter
saying this is what these are the grant
areas that we need that we need to
prioritize right now whether it's we're
talking facilities um we need we need a
new veterinarian um let's focus on
finding grants to fund that staff
position uh whatever it may be that that
can be stru you could have someone who's
sitting in there in the regular board
meetings whose task is to advise them
that they would then have to take that
into account in the structure of of how
their bylaws
are go ahead Madam chair um I think
that's great in theory but if there's
any kind of Staffing that's being funded
usually those grants are accessible
through local and County government and
those are where those grants should be
um acquired accessed and used it
shouldn't be through a friends
organization to pay for a staffing
position that is funded by the city and
the county um that's where we get into
really Muddy Waters especially with a
policy board so I'm going to have to say
that's kind
of not where the scope of a friends
organization I want to see go um but
like I said and you know if we can get
Maybe a little consensus on this I would
like to see a scope of Clint where you
want to go with this you were given two
options by our attorney where do we want
to go how are these funds going to be
used because I think we should be going
after every non or um every gr dollar
possible but we also are you know we're
jpa with the county and the city and we
do a lot of these things already so I
just want to make sure that we're not
stepping on toes and not making it hard
for both entities to do the work that
they need to do to help Animal
Services if if I may thank you um board
member Shel Hernandez I have you um
board member Corin
um we have a grant
team here with the city that doesn't
focus on animals that's why we created
the grant writer position which has been
vacant for some time and work in and and
we started to look at the number of
areas um that we could spend our time on
um more specifically to help supplant or
leverage the money that the city and
county give and and we had been with the
grants she had written pretty successful
um and so I don't agree that our grant
teams here at least in the city um
specifically address animal animal
issues it our sites are in other other
bigger um bigger things not that Animal
Welfare isn't important to me it is um
but it's it's second or third fourth
it's way down in the priority and we
don't look for those kinds of things if
there is an
opportunity um to work together what I
see is we have a lot of animal um
Advocates that are working in a lot of
different areas is to receive grants and
some of the reasons why we had worked
hard to agree that this overarching
group that has all the advocates in one
space was to work on minimizing the work
the silos and to work towards some of
the more priority areas but I don't know
that that has evolved over time and
since then we've had two or three
different coun um boards um changes so I
know this has been something as a
longest standing board member that Clint
has wanted to do this sort of fell in
his lap and it was something that I
thought could work
um and and so I think I I don't disagree
that Clint should you know this is what
I'd like to see happen and what the
areas are priority Spa areas that we
could work with in tandem with a
501c3 um but I I don't believe that at
least through and I'm looking at Leanne
because she has more of the our our
grant team does not specifically address
these sorts of things and and she can
say more about it but um I know that one
of the bigger issues was focusing and
leveraging the funding that we do have
um currently and that's why we have a
grant writer to work on that um Clint
thank you well you're going to talk
about this issue here yes you alluded to
one question that I wanted to ask and
and Ben you're probably the best to
answer this is what's the difference
between option number two which was to
have a subcommittee and that's going to
be pursuing grants and us having already
a grant writer that writes grants on our
behalf well at the Clint uh and Madam
chair at the I guess there wouldn't be
too much difference in in except maybe
what you would do is you would give the
grant writer position the oversight of a
subcommittee and they're they're M
possibly tasked with doing the community
networking that needs to be done to find
access to things locally or or at least
in a a local Geographic scale that she
might not be able he or she might not be
able to um address indiv individually so
you have a committee of volunteers
potentially of people designated by the
board to help with in that capacity and
then her his or her position would um
would allow the application for various
different grants primarily so it sounds
like there there would be a lot of
duplication in in having a grant writer
on staff and also having this option two
of having them pursue it it just it
seems like option one is the way that we
would like to be make like um
commissioner said be the most beneficial
to the the center as far as what what
they would be
doing you know grants in the animal
industry are an interesting thing
there's some that are very specific um
like the list that I pulled up senior
animals very specific but it's just to
benefit senior animals it's not so then
we have to come up with a program to
that's going to benefit and then we
apply for that Grant uh sometimes it's
just for General support and we apply
for it and we get selected and we can do
whatever we want with the money so uh as
far as saying what we would do or what
the friends of would be is yeah they
would get direction from from us hey do
you will you please pursue a grant for
Education we have an education program
where people can go we have staff that
can go into a school will teach the kids
about being safe around animals and wide
licensed Etc the grant will pay for
Education material it will pay for for
this and this and this and then they
would pursue that Grant they'd go after
it
so that is my thinking you know of um of
what this friends of would be
doing but if if we get more specifics
from the board of whether to pursue this
specific 501c3 then I can get you more
specifics of you know possible board
members or possible um direction to go
how many we can get bylaws all that but
if the board does not want me to pursue
it U because of the history that it has
that's perfectly okay we and we'll
continue to look for other options um my
problem for the last six years I've been
here we I have had I've asked would you
be interested in starting a 513 would
you be that and I've asked several
people and the answer is no they're just
too busy um and and and so that's why I
felt this was attractive because like uh
attorney said we already have a lot of
things in in the books so to say as far
as contacts
and instructions things like that that
we need to
have thank you Clint um board member
Corin so I'm just gonna say no I my my
recommendation would be that we do not
take up a 501c3 that already existed in
the community I don't don't think that
it's parallel enough to a friends of
organization I think a friends of
organization that establishes a
governmental relationship takes a lot
more um effort so I would just I I don't
I I would say no Um this can if someone
wants the
hssm moniker or 501c3 I don't I'm not
comfortable with us taking that over and
I don't think that would be an
appropriate start to our whatever if we
wanted a nonprofit arm and I would also
argue aside from the
seeking grants this is also something to
kind of I will be frank about it skirt
the anti- donation Clause because
friends of organizations don't have the
same rules related to the anti-d
donation clause and I think there's a
lot of legal gray area in there that
would have to be parsed out that's very
different from a community- based
501c3 that I that's why I feel like this
I don't think it's um advisable for us
to take this up I think it It's too
convenient frankly um and I have
concerns about the origins of it so uh
if and again I think establishing a
friends of is not a not
a bad idea potentially depending on all
the things but it doesn't sound like
anyone has the capacity to do that right
now from what I can hear in terms of the
amount of work that would be required to
to go into establishing that so I would
argue I would say that we um say no to
this opportunity um just because I don't
think it's quite so simplistic to just
adopt a 501c3 that's in a governmental
organization that's that's associated
with something like the city and the
county so I guess that would be my the
short of my my thinking on this um but I
defer to you all too Madam Vice chair

Corin if I could I I want to say thank
you for the bluntness and being straight
up forward it it helps us a lot to be
able to move forward so thank
you thank you Clint board member flotes
thank you Madame chair um my question is
this um a and um count uh board member
Coran touched on it um I don't think
it's within our purview uh to uh be
intertwined with the 501c3 at all uh I
think we need legal advice from our City
attorney and the other is um the other
would be the financial aspect you get
that 51 C3 money and does that go does
that go into a line item with our
budgeting and our financial uh you know
our finances so um I'm very um and and
and the issue that uh that councelor
Coran raised raised is
whether a governmental entity um has any
um such as the because it's a
governmental
agency um whether it has
um whether it has any
autonomy uh to to go after a
501c3 because because the the uh Animal
Service Center is a fun
of our
jpa between the city and and the county
so the question is um
how viable or how legal uh would it be I
think that you have to look at the
relationship that the center has with
two governmental bodies not just one and
um and whether a 501c3 can function uh
with that governmental uh
control and I'm just uh I think we need
answers do you did you research that
part or do you know well uh Madam uh
counselor
the the by virtue just by virtue of
being a jpa the Animal Services Center
is still an independent government
agency that's how the statute sets yeah
these up so it is an entity that can
apply do everything that is the the
statute reads that they can apply to do
just about anything that they need to
that's permissible for other government
entities in the state of New Mexico
financially employee wise and so this
would be a permissible thing
relationship to have as well if it's
permissible for one type of government
agency to have the 501c3 relationship
again it's it's a 501c3 that's created
that has its own bylaws that expressly
State we exist for the purpose of
assisting this entity and the resource
sources and the information and the
benefits That We Gather flow through us
to that entity to assist in the mission
of that entity so that's that's how that
structure works now whether or not the
the board thinks it's prudent or wise at
this time to do that that's that's your
your call um but it is something that
that does exist it's I not familiar off
the top of my head with other jpa
entities that have this type of
relationship but that's something that
can be looked into further if we would
like but by virtue of being an
independent government quasi government
entity that has independent structures
and and exists to pursue different
things that the city and the county are
not doing because they've delegated that
authority to the ascmv they're able to
do that okay and that was one of the
benefits of uh Miss Barker Frank Bryce
so just just saying in terms of the the
springboard conversation I know that
there is
um issues with with that relationship
and that so I'm not commenting on that
I'm just saying that in terms of an
entity approaching the ascmv and saying
hey we're interested in converting our
broad mission statement for what we
exist to do in this community and
narrowing the focus of it to exist only
for your benefit they can do that and
that's what triggers this conversation
and so then if it's advisable to pursue
that relationship maybe maybe not or if
the board wishes to go a different route
and see if there is interest in the
community of of people who would like to
exist in that capacity to benefit the
asmb that's these other entities that
exist locally don't exist in that
capacity they exist in their own
personal mission based hey we want to do
X Y and Z for animals in the community
they don't exist for the purpose of
benefiting the ascmv right but um that
may be true but um there there is a
difference in so far as whether that
money was designated specifically for a
certain purpose we don't know I don't
know um the other is that um in in you
know the the example that uh Miss Deo um
our finance director Miss Deo brought up
um about the
um we have the friends of the library
but the friends of the library um is
functions so differently I mean it's
they they meet upstairs and at the at
the uh banigan
Library um and and they do a lot of
things for the
community um and uh but the Animal
Service Center and and they don't have
the added um infrastructure
that that forms the uh as uh CMV they
don't have a joint Powers agreement with
anybody in the world and and that is my
concern my concern and I'm not I I would
like to
um I I think there's just so many ifs
and so many unknowns um and uh and I'm
not entirely sure that I understand it
all I mean I understood what you said
but um what I should say is that I'm not
firsthand knowledgeable and I
would so and councelor Flores that that
is precisely why we're here today to
have this conversation because we the
Clint is asking for direction to learn
more about these
options to go down One path the other
path or no paths um having the knowledge
of the friends of the library
organization however it may be that that
could be helpful we can then sit down
and talk with board member Deo and see
if we can get connected with whoever is
in charge with Friends of the library
and see what their structure is and
maybe if that is something that works
well with the city and they do exist
independently of the city as was
described that might be the model that
we follow and their their mission
statement is just changed to reflect the
asmb instead of the library correct and
I it would we'd have to look at if we
were to go down this road we'd really
have to look at the um freestanding um
like a sovereignty of theirs uh separate
and apart from the city and that that
would there therein lies the rub uh so
um I think that there are more questions
and answers at this point um and uh at
this point I mean I I mean when I was at
at the at the new center I this is so
beautiful and and just on the way home I
thought oh it'd be great if we had a
501c3 but when I say we I'm thinking
more of our community and and I have to
detach the city and my representation uh
of and for the city so um so we still
have a lot of questions to answer I
think it's be wonderful to have that and
what wait a minute what happened to our
um grant writer and how long has she
been been
gone uh Elaine left
us it's probably been about six months
now at least but she's on contract and
she does contract work with us oh so
she's still available to do grant
writing yes yeah she's written two
grants for us since she's been on
contract okay and the grant writing that
she's done has it been fruitful have you
got good Returns on it have not been or
it hasn't been answered yet so it hasn't
been processed and selected
but if you remember she
does it has been fruitful we've received
numerous funding um when she was hired I
remember that but it's been quite some
time since there have been a report on
that but anyway so anyway I think that
there's just more questions and answers
can you give some direction to Clint
because I think that's what he's asking
yes there's questions but how does the
board want to direct him to move forward
it sounds like very clearly and I'm
going to S I'm going to put this is no
to the Humane Society use of the 501c3
it looks like there's enough um concern
about that but it it it begs the
question do we move in this direction
and if so what are we directing Clint to
do at this point about a friends of the
Animal Services Center I don't think we
can really direct him because we don't
know where to what we we we as a as um
one of the parties to the jpa have to
establish what our parameters may be or
our limitations and uh whether it's
possible to have
um to have just a SE total separation
you know the is it possible for the U
for the center to have a um 501c3 that
is totally separate and apart from the
city and I don't know know if that was
the case if someone could say oh yes it
could be set up that way um that would
be great but I don't think that the city
uh really has
um I I would need just a lot more
clarification if the jpa status would
allow us to even have uh you know be
somehow involved with the
jpa and um and what it would uh you know
how it would impact the board we
wouldn't be able to tell you what to do
with that
money um it's not our
money and I don't know I don't know I it
just and then would that money be
comingled with the money that that the
city yeah so we wouldn't that would be a
totally different bag thank you Flores
um for me I think and maybe you can
answer this Ben um because you are the
attorney um for
asmv um I'd like for us to explore it I
think there needs to be a considerable
amount of u more research done about
these kind of JP pasas that exist and is
there some out in the nation that
utilize a friends group um would be my
direction to Ben and Clint um I think um
councel flid does you make some great
points about our attorney having the
city's attorney look at whether this is
something that can
exist um um from the city's perspective
I think you make a great Point um
but and how would the duties be
distributed would it be a board you know
that's separate and apart like other
friends um boards are
specific to this to this particular area
that would be
my my recommendation to Ben and
Clint and to board member
dush because you're here from the
city anybody else any um feedback from
the um
public please make your way down Jerry
and States your name for the record

board hi Jerry Wheelis um would there be
any problem with
just community members getting together
and establishing a
5013c for the benefit of the shelter has
nothing to do with the city
that's I mean that's on the table right

too uh Clint ther executive director I
there still the issues that were coming
up was if the you have no control over
the money that's coming in the money
comes in what do you do with it I mean
if if it's a group of citizens that come
in and give us money that's great it's a
donation um currently right now what we
we do with donations if it's a specific
donation for a specific reason we come
to the board and we say this to accept
this donation for this specific reason
and then the board accepts it or denies
it and then it's used for that specific
reason or we get just a general donation
say we like to give you $50 and it goes
in our donation line item so that's
currently how we do it but I don't see a
difference between a 501c3 giving us
money and a group of citizens giving us
money for a specific reason reason and
then how it's handled but that's just me
do you you have any difference it would
eliminate a lot of the strings if a
communitybased
5013c gave you donations and
board um board chair we would I would
probably need to get with our City
attorney um we also have a I also have a
tax attorney that works with us as well
and so we probably would need to seek
out advice and I maybe even and the
County Attorney as well so seek out
advice I I don't think that we're saying
that for for financial purposes okay
we're not saying that the 501c3 wouldn't
work I think um establishing the board
and having those bylaws as long as
they're very clear and precise of how
you know the funding will be and what
it's going to be used for and the grants
that they're going after so that way
there's no co-mingling and and just you
know for events and things like that
that we just make sure that um you know
that we don't um the past doesn't happen
again um I'll just say it that way so I
know that um Clint as you know Kathy and
I have talked about um we've kicked
around the idea of a
5013c um for the benefit of the shelter

females and if they can't pay for it I
put it in their donation box instead
of well no for the ones that do pay I
put another $40 In Their donation box so
then they get actually $80 for every
female cat they spay thank you so I
really would like to see it go forward
whether it goes under the
old one or I will convert my business to
profit them because I don't want the
4,000 I could use it in my life just
like everybody
else but I want it to go to them because
$40 a spay that means a hundred cats can
get spayed with my 4,000 and that would
be my purpose is to give it to them for
the 4,000 or the 100
cats thank you my mission is getting
those female cats and dogs I haven't
started the dog part yet yeah but I'm
determined to get as many Spade as
possible for the oppr

third Thursday but we do need to decide
on a date is the city um Chambers
available for those dates that I do not
know right off the top of my head I
would say you need to know that first
before we agree
right we can agree to look into it maybe
the 30th would be better I don't know
but and then or leave 1630 and
then 16 16th and
30th can we get
um Leanne someone to look at that as
we're M moving through um the the rest
of the agenda so we can confirm it's
really hard to get all of us together
and agreeing on a date and so we've
agreed 16th and 30th but it depends on
the chamber availability yeah board
